Valiant Solar and Gold Key/Dark Horse Solar are the same in name only. Presumably, you can have the Phil Seleski character, which is NOT the same as the Gold Key character, still in the Valiant Unverse. Just use a different name. I'd say option #1 is flawed, as Dark Horse won't be publishing Valiant characters. They'll be publishing characters once published by Valiant, but never owned by them.
