I've been working through the OTV podcast, and enjoying it a lot.
I've been listening to Episode 13: the Future of Magnus Solar Ect

They were talking about how non-Valiant copyright ownership applies to Gold Key Dr Solar and the iconic suit but not the character of Phil Sileski. So it was suggested if the emergent VE wanted Phil they could probably do that. Carefully.

So, why didn't they?

Speculation? Knowledge on this subject? Ignorance on this or any other subject?
I've been looking everywhere for the ultra-rare Turok vs Blister issue. Anybody able to help me out?

Oops I meant to post this in the GENERAL VALIANT DISCUSSION... honestly I'm not sure I understand why some of these forums are separated...they involve the same topics it seems to me...I'm not questioning or complaining just sharing my experience or lack thereof

I don't know why VEI can't use the 3,but every other company can.I like Divinity better than Solar anyway.Magnus can't be replaced and Savage has a lot of potential.V2 had the seleski twins who were planning to take over the world and Acclaim's magnus basically ran from their :atomic: like a punk.

Usually with licensing rights like with the Gold Key 3, new characters that are created that are derivative of the licensed property remain the property of the original property. That's likely why Fred Bender/Doctor Eclipse hasn't appeared in VEI (since an eclipse is related to "solar" activity), I imagine that since Phil was Solar's identity, he's in the same boat. Or simply just that isn't all that interesting a character to do anything with, without the Solar identity.

The only company that can do anything with the characters is the company that has licensed the rights.

I’m pretty sure that it’s all a tangled mess. I asked about Phil Seleski early on and again after another company used the name in solicitation. No answer both times. I can only guess from that, that it was not worth the trouble.
It's not that I don't have an avatar... I've just been working on it for the last few hundred years.

Thanks all. I like Aram's thoughts the best, that Phil was probably just not worth the trouble of getting into a potential legal mess, even if they were in the right.

This is something that gets me. Plenty of people (I know some) fight really hard and spend vast amounts of money time and even years of their lives to achieve some goal that is entirely not worth the cost.

Not sure if it means anything, or even if I remember correctly, but I think the name Phil Seleski came from a relative of Jim Shooter.

Yes, you're right, that's what I was thinking about. I even had brother-in-law in the back of my head. But I double checked and see that it was a similar story for Seleski as well. I quote from THE inteview: "Phillip was my grandfather's first name - my mother's father. Seleski was a simplification/corruption of "Streczletski," my paternal grandfather's last name. When he passed through immigration at Ellis Island, they changed his name. Later he had it legally changed back to its original form, then later changed it again to Shooter, a direct translation of Streczletski. See, he wanted to have his real name, but he wanted to be "an American" too.". Anyway, that's a bit too obscure to have anything to do with why the name is not used anymore, but I leave it here as a bit of trivia.

Phil really is a Valiant character but like Dino said, in the eyes of the law its derivative and therefore belongs to the solar owners. Kinda lame if you ask me but I understand.
