I don't think there's much debate that if you count the intent of the voter on all those Buchanan votes on that crazy butterfly ballot, the outcome was clear. I guess the intelligence of the voter must count for something though - although that ballot was REALLY bad.
I'm all for saying that a state vote is within a "margin of error" and splitting the electoral. This is what a scientific poll would do. There will always be error/fraud in the process.
