There is no way of saying SM #1 is a little grey area-ish and the Visitor #1 is a "clear" violation. No way!
Shadowman is only finding and wearing his mask alongside plain black clothing. That black suit is not just missing the logo. The proper blue-ish Shadowman costume with the logo on its chest is "clearly" given to him by Nettie in the second issue thus he cannot be wearing it in the debut issue. Nobody will have to give the Visitor his costume (and mask) as he's already wearing it and it can be assumed the mask is just hidden under the hood (as seen on one of the variant covers).
The only "clear" violation of the rule is XO #1. SM #1 is very grey area-ish as Jack is simply not wearing the proper costume when he confronts Samedi as seen on the cover. The Visitor is slightly less grey area-ish; at least based on costumes and masks alone.
Another different case of grey area is Pete and Harbinger #1 by the way but it's even less grey area-ish because he's only wearing the wrong tee and can easily be recognized as he's not wearing any mask (yet). He is also given the costume in the second issue.
