New Harbinger HC and the Disputed Trademarks
As most of you may remember, Harbinger was one of the disputed TMs that VIP was going after.
With the HC coming out through VE, can it be assumed that VE has managed to retain all the TMs or just this one?

I thought it was one of the few that was not in dispute... Do you have any links to the old threads we were discussing it in?

Here's the original story
In checking on the status of the trademarks of the former Valiant characters, Newsarama learned that 12 of them, as well as the term “Valiant” have been acquired by Valiant Intellectual Properties, LLC, a Delaware-based corporation. Trademarks now owned by Valiant Intellectual Properties include: Secret Weapons, Outcast, Rai and the Future Force, Deathmate, Quantum and Woody, Harbinger, Punx, Dr. Mirage, Eternal Warrior, Ninjak, Bloodshot, and The Visitor.

Maybe Not....The story is centered around the Origin of Harada and might NOT include anything even associated with Harbinger thus NOT effecting the tradmark issues if they are still in question with this mark...Zero wrote:Wow! I guess they must have worked something out then?
I understand being able to reissue reprints, but I'd guess that the new story makes a TRUE statement as to who owns the Harbinger TM.

Thanks for the reminder! I had forgotten which were trademarks were in that category.ManofTheAtom wrote:Here's the original story

Of the 12, Outcast, Deathmate, Punx and Visitor are no great loss. (Visitor's secret was out anyway....)
So a Harbinger TPB means some kind of settlement has been reached, right?

Actually, according to that story there were 13 TMs in danger, with the VALIANT term being the 13th.
VE's usage of both the VALIANT term and logo, along with the usage of the Harbinger name, probably indicates that VIP lost.
One TM I knew VIP had gotten approval of was Dr Mirage or Bloodshot, I don't remember which one. I hope VE went after whichever it was

I seem to think it was Dr Mirage (which although not a great loss to many, I would see as a shame as I really enjoyed reading the series).ManofTheAtom wrote:Actually, according to that story there were 13 TMs in danger, with the VALIANT term being the 13th.

Definitely one of the better written and drawn Post Shooter series.xodacia81 wrote:I liked Dr. Mirage. It was a fun book with good art. Sometimes all the "oh baby" stuff got a little sappy, but that was part of the charm. You had to feel for these two people, who so deeply loved each other. It didn't hurt that Carmen was a smoking hot babe, either.
VE needs to get Bernard and Layton back on Dr Mirage.

Just checked the trademark office. Don't know how accurate their info always is (I've actually spotted a few Acclaim comic trademarks that still show as live), but the VIP Harby trademark was filed right after the auction, and marked for opposition as of August 2006.
There is another trademark (unopposed) filed for Valiant Entertainment Inc. as of December 21, 2006.
I don't know much about trademarks, but would the office allow someone who is challenging a trademark to file a registration of their own? To me, it looks like this one may be VE's free and clear.

Here's another update - VEI also has trademarks listed for the following trademarks as well (all filed in December 2006, after the dates where VEI filed oppositions to VIP): Rai and the Future Force, Quantum & Woody, Eternal Warrior, and Ninjak. That still leaves Bloodshot, Dr. Mirage, Deathmate, Punx, Secret Weapons, the Outcast, and the Visitor in question.

If VIP gets anything (which they won't) then let them have Punx & The Outcast.....davidb wrote:Here's another update - VEI also has trademarks listed for the following trademarks as well (all filed in December 2006, after the dates where VEI filed oppositions to VIP): Rai and the Future Force, Quantum & Woody, Eternal Warrior, and Ninjak.
