Unity Diamond Ebay Problem

Post by geocarr »

Okay, I won this auction last night for the Unity Diamond TPB Vol. 1 and almost wet myself.
Unity Diamond TPB Vol.1
I received the following message from the seller, remohcomics:
Dear geocarrjr,
Hello, this is a strange situation. I am going to be completely honest with you. I cannot afford to sell this to you for the price you won it for, I paid much more for it. I honestly thought it would sell for more than it did. There was an error in the listing that I couldn't change once bidding started, and should have ended it early. I really hope you can understand, with times as they are, I just can't afford to loose money. I hope that you can understand. I appologize for any inconvenience, and as you can see, my feedback is 100% positive. Nothing like this has ever happened. If you need to leave neutral or negative feedback, I understand, and that would only be fair. However, I would like to extend a $10 credit to you for any future auction of mine, Remoh Comics, in return for your understanding, and my word that this will never happen to anyone ever again. I will leave positive feedback for you tonight regardless. Please let me know how you feel. Thank you. Adam.
I responded with the following:
Dear remohcomics,
You have got to be kidding me! You have been an EBay member since 11/9/03 and have over 1000 feedbacks, so you know exactly how this works and the potential profits and losses when you list something. I have been trying to get a copy of this book for over 2 years and was unbelievably excited last night when I won. I thought it was going to go for more too. But we have both entered into a contract and I want the book. I honestly wish you better luck with future sales. Please reply.
George
remohcomics then responded with the following:
Dear geocarrjr,
George, I appreciate your anger. It is bad form on my part. The simple fact is that I would be loosing a lot of money, and with things the way they are right now, I can't. It is irresponsible of me, I know. As I said, I will understand what ever course you take. However, if you do decide to leave the transaction where it stands, I can offer you a $20 credit with any of my auctions in the future. Again, I appreciate your emotion, as well as letting me be completely honest with you. I appologize for any inconvenience, and hope you can understand. Adam
I have not paid anything to him yet and ultimately I want the book.
What do you think my next move should be?
Thanks for the feedback in advance!

If he was that worried about the price, then he should have set a reserve. The last one up on ebay sold for around $155.00 a couple of weeks ago, so he's not out a whole lot of money. It's not like you won the thing for a buck.

Personally, I would just neg the guy and tell him to keep his credit. I certainly wouldn't do any further business with him.

Definitely post negative feedback, explaining explicitly what he did. Also, file a case with eBay reporting him as a non performing seller.

the guy's also a keyword spammer, as he uses CGC in his listings for non-slabbed books.

It's ebay. Come on, that's the risk you take! (talking about that guy, not you) The guy's an idiot. That was a great price. I'd be *SQUEE* to.

definitely leave neg. feed back and then report him.

Maybe someone needs to remind him of the definition of the word 'Auction'. You're not guarantied a profit.

I feel for you bro. :!:

What crap. If he insists, negging him and reporting him is obvious, but also all you can do. You could contact him again, politely telling him that you will report him, but I wonder if that helps. Looks like you will either report him now or after one more exchange of emails. You deserved this book.

Wow glad I stayed out of this one. Geo would have killed me

Than again Im really glad I did as I would have been super *SQUEE* if this guy pulled this crap.

What I dont get is it sold for $100 and he is offering $20 so thats $120. The guy is crying about losing $30 as they have been going for $150-160.

Im betting he got a higher bid on the side from someone

It's possible.

Something similar happened to me one time after I won an auction on a fairly rare item. I reported it to ebay, but of course they wouldn't do anything about it.

Report him either by phone or email to eBay. This clearly falls under seller non-performance and is a violation of ebay sales policies.

Also, as a seller you can still cancel a listing even if it has bids. You just have to cancel the bids first. He could have then relisted it with any chnages he wanted such as adding a reserve.

he is legally obligated to sell this to you and you can take him to a small claims court which you would win plus your costs paid by him.
Of course i realise thats a bit OTT, but im just saying.

I believe a similar situation came up not too long ago, and it was asked if it was worth it to go through with a lawsuit.

I believe the answer came to be, in shortest terms, "neg him and move on."

BTW - make sure you use the word "*SQUEE*" somewhere in your negative feedback.

I'm not sure what he was hoping for...

If he was THAT worried about it he should have just put a BIN on the item and left it...

Leave a NEG. Sorry to say you might have to move on from it...

He should honor the final auction price. If he wanted to make a profit or break even, he should have set a reserve or use Buy-It-Now. He's an eBay veteran so there's no excuse.

I would neg him and move on.
