That happened later, remember in the 89 Burton Movie where knocks Nicholson into a vat of chemicals that turn him into the Joker? That scene looks like it was inspired by the ending to his first appearance in Detective Comics #27 (or it could also have been inspired by Batman: The Killing Joke). Also in Batman vol. 1 #1, which is the first appearance of the Joker BTW, that story ends with Batman stabbing Joker with own knife in front of Robin.

If DC had kept him like he was back in the day chances are Batman would have made charaters like The Punisher and Jennifer Blood look tame.
